Academy Pro - Sports Academy Management

Please read these Terms and Conditions ("Terms") carefully. These Terms govern your use of the "Academy Pro" mobile application and related services (the "Service"). By creating an account, clicking "Agree," or using the Service, you ("User," "you," "your" - referring to the parent/guardian for minor members, or the independent adult member) agree to be bound by these Terms, which form a legally binding agreement between you and Academy Pro ("Academy Pro," "we," "us," "our").

Note: If you are a Sports Academy, separate Terms and Conditions apply to your use of Academy Pro.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 18 years of age and legally capable of entering into this agreement. If you are registering for a minor, you confirm that you are the parent or legal guardian and have the authority to agree to these Terms on their behalf.

2. The Academy Pro Service

Academy Pro is a platform designed to facilitate interaction between sports academies and their members. It enables you to:

Register and manage member profiles (for yourself or your minor).
View and book academy activities and classes.
Track attendance and progress (including sensitive data like anthropometrics and performance metrics).
Make and manage payments for academy services.

3. Account Creation and Responsibilities

3.1. You must provide accurate and complete information when creating your account.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. You agree to notify Academy Pro immediately of any unauthorized use of your account.

3.4. You are responsible for any fees charged by your mobile service provider for internet access or data usage when using the Service.

4. Data and Privacy

4.1. Consent for Data Collection: By using the Service, you consent to the collection, storage, and processing of your personal information and, for minor members, your child's personal information (including sensitive data such as anthropometric measurements and performance metrics), as described in our Privacy Policy.

4.2. Sensitive Data: You acknowledge and agree that anthropometric data and performance metrics will be collected by coaches for the purpose of tracking progress and improving training.

4.3. Privacy Policy: Our comprehensive Privacy Policy, available at academypro.mv/privacy, details how we collect, use, store, share, and protect your personal data. Please review it carefully.

5. Payments to Academies

5.1. Academy Pro facilitates payments from you to the sports academies for their services. We are a payment facilitator, not the direct recipient of your payments for coaching or classes.

5.2. All payment transactions are handled by a third-party payment gateway provider. Your payments are subject to the terms and conditions of that provider.

5.3. Refunds: Any requests for refunds for services provided by the sports academy must be directed to the academy directly. Academy Pro is not responsible for issuing refunds for academy services. Your ability to receive a refund is subject to the specific refund policies of the individual sports academy.

6. User Conduct

6.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.

6.2. You must not use the Service to:

Upload or transmit any content that is unlawful, harmful, defamatory, or infringing.
Interfere with or disrupt the integrity or performance of the Service.
Attempt to gain unauthorized access to the Service or its related systems or networks.

7. Intellectual Property

The Academy Pro software, its features, design, and content (excluding your personal data and content you provide) are owned by Academy Pro and are protected by intellectual property laws.

8. Disclaimers and Limitation of Liability

8.1. Service "As Is": The Service is provided "as is" and "as available," without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or entirely secure.

8.2. Academy Services: Academy Pro is a management tool for academies. We are not responsible for the quality of coaching, facilities, safety protocols, or any other services provided by the sports academies themselves. Your relationship with the sports academy is separate from your agreement with Academy Pro.

8.3. Waiver of Liability for Sports Activities:

You acknowledge that participation in sports activities inherently involves risks of injury, property damage, or other losses.
By using this Service to manage participation in such activities, you (on behalf of yourself and any minor you are registering) understand and voluntarily assume these risks.
To the fullest extent permitted by Maldivian law, you hereby release, waive, discharge, and covenant not to sue Academy Pro, its affiliates, officers, directors, employees, and agents from any and all liability for any loss, damage, or injury (including death) that may be sustained by you or any minor member you are registering, in connection with any sports activity, whether or not managed or scheduled through the Academy Pro app. This waiver applies whether the injury is caused by the negligence of Academy Pro or otherwise.
You acknowledge that separate waivers and consent forms may be required by the individual sports academy for actual participation.

8.4. Limitation of Liability: To the maximum extent permitted by Maldivian law, Academy Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any conduct or content of any third party on the Service; (d) any injuries or incidents occurring during sports activities.

9. Indemnification

You agree to indemnify, defend, and hold harmless Academy Pro, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any privacy or intellectual property right; or (d) any content you submit to the Service.

10. Termination

10.1. You may stop using the Service at any time by deleting your account.

10.2. We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for any reason, including but not limited to your breach of these Terms.

11. Governing Law and Dispute Resolution

11.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Maldives.

11.2. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved through amicable negotiations between the parties. If negotiations fail, disputes shall be submitted to the competent courts in the Maldives.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page or through other appropriate communication channels within the app. Your continued use of the Service after such notification constitutes your acceptance of the revised Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Academy Pro regarding the use of the Service.
